How does GDPR regulation affect Inbound Marketing

The GDPR, which we'll discuss in detail below, is the new data protection regulation that HubSpot is implementing. As we approach May 2018, HubSpot is focused on GDPR compliance efforts . During this period of GDPR implementation, businesses must evaluate new requirements and restrictions imposed by the GDPR and take steps to ensure that we handle customer data in compliance with applicable laws before the 2018 deadline.

What is the GDPR regulation?
The EU adopted the Data Protection french business fax list Directive (DPD) in 1995, which is based on the protection of the fundamental right to privacy of EU citizens and covers all information relating to a living person. EU member states drafted local legislation to give effect to the DPD's objectives. The DPD prohibits the sharing of personal data outside the EU without adequate protection, and sets out the 8 principles of data protection on which the GDPR is based.

The General Data Protection Regulation (GDPR) adopted in June 2016 requires compliance by May 2018. In short, the GDPR regulation expands the definition of personal data and sensitive data . Personal data now expressly includes an identification number, location data, IP address and online identifier. Anonymized data is not considered personal data.

Scope of the GDPR regulation
The GDPR extends the territorial and material scope of EU data protection legislation. It applies to both controllers and processors established in the EU and those outside the EU, offering goods and services to or supervising EU residents.

Reporting
Controllers are required to report data breaches to their supervisory authority within 72 hours unless the breach is unlikely to result in a risk to the rights of data subjects; they must also notify data subjects where the breach is likely to result in a “high risk” to data subjects. They must also keep an internal record of all data breaches.

Penalties
The GDPR regulation gives supervisory authorities the power to impose significant fines on controllers and processors for non-compliance. Companies may face fines of up to €20 million or 4% of the total annual turnover of the previous year. Fines can be imposed in addition to, or instead of, any corrective measures (such as warnings or reprimands).
